A McHenry County Judge said Friday he will appoint a special prosecutor to examine whether State's Attorney Lou Bianchi improperly ordered a former secretary to do political work on county time.
The decision, the latest development in a controversy that has been simmering for almost two years, was not unexpected. Bianchi as State's Attorney is the county's criminal investigator and prosecutor but the case involves allegations concerning his own alleged wrongdoing.
In a prepared statement Bianchi said, "I am satisfied that this matter will be aired in the proper forum – a courtroom – instead of irresponsible and false statements by my political opponents to the media."
The special prosecutor Judge Gordon Graham will appoint, perhaps later this month, will be the second in the case. An earlier special prosecutor appointed at Bianchi's request, David O'Connor, won a guilty plea in March from ex-secretary Amy Dalby. Dalby admitted she had copied and carried off on a flash drive thousands of files from the State's Attorney's computers.
Dalby claimed she took the records to protect herself in case Bianchi was ever charged with wrongdoing but, according to an affidavit from Bianchi's primary opponent Dan Regna, she shopped information from them to a "Daily Herald newspaper reporter" during the primary.
Then-columnist Amy Mack first published charges Bianchi was using county money to pay for political expenses two years ago but never revealed where she got the tip. Mack is "no longer employed" at the Daily Herald and could not be reached.
Similar charges turned up in an anonymous complaint to the State Attorney General the following month. Two months later the AG ruled there was nothing to investigate and revealed the complaint had come from ex-Assistant State's Attorney Kristen Foley.
McHenry County blog publisher Cal Skinner discovered Foley had been circulating petitions to put Regna on the ballot at about the same time she sent the complaint.
In the primary Regna lost to Bianchi who went on to defeat Demcratic opponent Tom Cynor in the general election. Meanwhile, Bianchi decided someone had been leaking office records and after the election called for a special prosecutor to find out who.
Dalby pleaded guilty to computer tampering but what else, if anything, O'Connor found in his investigation is still hidden in grand jury records and behind sealed case files.
The latest special prosecutor will return to the question of whether Bianchi did anything wrong in the first place.

FEN Finds Dalby/Foley Connection

Other than that both once worked for Bianchi, none has suraced. However The First Electric Newspaper has been able to confirm this week that the two women share another connection, a political one at that.

Grafton Township Attorney Resigns
Grafton Township found itself without a general attorney Friday following the resignation Thursday evening of recently-appointed Joe Gottemoller. The township board and its supervisor are badly split among themselves and Gottemoller said he couldn't work with them anymore.
Gottemoller was appointed to replace Township Attorney Jim Kelly after Supervisor Linda Moore defeated John Rossi for her post. Kelly remains special counsel to the township, however, in the appeal of a McHenry County injunction against building new township offices which Moore opposes.
The conflict over those offices and support for the Grafton Township Food Pantry continued to bleed over into Gottemoller's bailiwick, however, he said, and he finally decided to call it quits.
"Neither side was listening to what I was telling them," said Gottemoller. "They seemed to feel I was favoring one side over the other."
Moore, recovering from a medical procedure, could not be reached for comment Friday.

Algonquin's Hanson Road Disappears
Hanson Road in Algonquin is closed between Huntington Drive south to Edgewood Drive. In fact it is rapidly ceasing to exist at all.
Workers are taking up and stockpiling Hanson's pavement to lay it back down again after sewers are installed and the road's subbase is replaced. Scott Hanson, Vice President of Curran Contracting Company, said the work involves taking up 4,000 tons of pavement for recycling into Hanson's new surface.

Huntley Library Shows New Addition Plans
The Huntley Area Public Library revealed more details about its planned temporary expansion Thursday at the Huntley Board of Trustees meeting.
The 2700 square-foot mobile classroom style addition is planned to sit to the library's east, painted and trimmed and landscaped to match it.
Trustees passed along the library's request to erect the temporary addition for three years for action at their next full meeting.

Stupid Deer Early This Year
A pair of husky fawns grazing along the Algonquin Road curve on the bluff in Algonquin Thursday illustrated the danger to motorists from white-tailed traffic hazards this Fall.
The Illinois Department of Transportation reported over 24,000 deer crashes in the state last year including 2 fatalities and over 750 injuries. McHenry County saw 366 crashes 6 injuries according to reports. Only about one in five happened during daylight hours, according to the stats.
The Illinois Agricultural Extension Service advises motorists to slow down if a deer is at the side of the road. There are likely more deer nearby and often follow one another single file across a road.
The Service also helpfully reminds that, " A motorist who hits and kills a deer with a motorized vehicle can legally claim the deer to salvage the meat, hide, and antlers."

Huntley Begins Downtown Revitalization Planning
Plans for Downtown Huntley revitalization may prove difficult to make if Wednesday's first public workshop was an indicator.
Shown nine different architectural styles by planners, about sixty residents chose as their top three preferences an 1830's Cape Coddish clapboard effect, an 1890's marble Beaux Arts collosus and an 1870's brick and glass descendant of the Crystal Palace.
Wednesday's meeting was planned to gain local feedback from residents on downtown revitalization, review past plans and studies and find out problems, issues. Consultants Houseal Lavigne quizzed attendees via hi-tech remote keypads to produce instant computer tabulations of their preferences.
Some findings:
Residents consider Huntley's downtown to be, well, mostly downtown, definitely on Main.
Traffic downtown is very imporant.
Preserving the downtown's character is important.
Downtown parking is important, too.
Attractive building facades will be imporant.
First floor retail, second floor apartments or offices are strongly preferred.

Health Care Vigil Canceled At Algonquin Library
A Health Care Vigil called by local MoveOn polictical action committee members didn't happen in Algonquin, Wednesday. Not, as scheduled, at the Eastgate Algonquin Public Library, anyway. The vigil's organizer and library officials both agreed they didn't understand what the other wanted.
The vigil was planned to mark the death of Sen. Ted Kennedy, seen by the group as a champion for public health care. The group had rented the public meeting room at Eastgate for 1 o'clock. Deborah Morton, Assistant Director of Neighborhood & Leisure Services at the library said she thought event was to be the usual discussion-style meeting often held by local groups at the library.
"My understanding was it was informational, not a vigil," said Morton. "Then I heard something about it on the radio."

The Grafton Food Pantry held what it called its "Grand Opening" at its new location in Huntley, Wednesday.
Volunteers spent the weekend moving equipment and supplies from the Pantry's old location at the Grafton Township Offices to the new venue at 12191 Smith Drive, and the grand opening looked pretty much like business as usual.
The Pantry was either the cause or casualty of a dispute over construction of new Grafton Township Offices. With Wednesday's opening the Pantry's website went dark. It had been hosted on the township's web location. (The site was back up Friday.--ed)

County Plans Flu Shots For Half Of Residents
McHenry County Health Department officials told the County Board Tuesday they plan to make sure roughly half of all county residents receive immunization against the H1N1 flu this season. They said it would be easier to make those plans if a vaccine were actually available.
Department Director Patrick McNulty told Board members H1N1 flu, unlike the common variety, hits young people hardest. By the CDC's recommendations he said, the county's "Tier One" population most in need of immunization stands at about 160,000 people.
Karen Ciesielczyk, Health Promotions Coordinator, said immunizations, whenever they become possible, would be available from individual primary care physicians. She said MCHD has also arranged for mass immunizations, however, at schools, hospitals and urgent care facilities throughout the county.
The World Health Organization has declared H1N1 flu a pandemic disease but Zaleski said that refers to how widespead it's become. "It doesn't speak to the severity of the symptoms," she said.
Indeed, despite early reports of high H1N1 death rates in other countries, in the U.S. the CDC reports fatalities have been about the same as from ordinary flu. Scientists fear it's a good candidate, though, to mutate into something worse. That's why there's so much planning like McHenry County's on immunization.

Real Estate Tax Assessments To Fall But Not Much
Tax assessments for the 2009 year will be out soon but McHenry County Assessor Donna Mayberry told a group of homeowners at a McHenry County Association of Realtors Seminar Tuesday not to expect much of a drop from 2008. The good news, she said, was that if county tax bills won't fall much next year they won't go up much, either.
Assessments of each home's value on Jan. 1 this year are, in fact, an average of its value in 2006, 2007 and 2008, she said, so the collapse in the housing market still hasn't had much of a chance to work its way into assessments.
"It works to keep assessments from rising too fast in an up market," Mayberry said, "but it also slows their fall when the market is going down."
Mayberry said there were so few home sales in some townships that her office was forced to group them with others to come up with sensible assessment numbers.
Against the slow drop in assessments Mayberry reported, is a very clear limit on tax levy increases. Illinois real estate tax levy increases are generally limited to either five percent or the increase in the federal Consumer Price Index, whichever is lower. Mayberry said the CPI has only gone up about .1 percent this year. "It's never been this low," she said.
"We're going to have what I call 'squeeky wheel assessments'," this year Mayberry told homeowners. "People are looking for ways to cut their expenses and I don't blame them."

The village will drill a new deep well and expand the water treatment plant near Square Barn and Algonquin Roads next year. The new well will tap an aquifer no one in McHenry County has ever used yet, according to civil engineer Thomas Talsma of Engineering Enterprises, Sugar Grove.
Current "deep wells" in the county draw from a water layer that contains chemicals and minerals that have to be treated in water plants before the water can be piped to customers. Talsma said recent drilling near Hampshire into an even deeper layer found water without as much stuff dissolved in it.

Haligus Closes In Lake in the Hills Through November
Work began Monday on Lake in the Hills' reconstruction of Haligus Road between Miller Road and Geneva Lane.
The $1 million project will dig up the entire crumbling stretch of Haligus, add a storm sewer and widen it to a three-lane section for left turns into Sunset Park and Bark Park parking lots.
The mostly federally-funded project is expected to shut the half-mile stretch of Haligus until some time in November.

Sheriff Busts Alleged ID Thief
A 30 year-old Chicago woman remained in McHenry Count Jail Monday after a nine-month Sheriff's investigation led to her Chicago arrest last week in an identity theft case.
Bond for Luevell Tracie Chester, 552 E. 51st Street, Chicago, was set Monday at $200,000 on six counts of aggravated identity theft, thirteen counts of theft, and one count of financial institution fraud.
The case began last November when a McHenry County couple found a withdrawal from their checking account they hadn't made. Looking more closely they found $51,000 had gone missing and complained to the Sheriff's Office.
Investigators said they found the money had all been electonically withdrawn over a more than two-year period. They said they followed an electronic trail to find the money had been used to pay Chester's mortgage, cell phone and credit card bills.

Hunger Hustle Benefits Food Pantry Sunday
About 50 area runners and walkers took part in Sunday's Hunger Hustle to benefit the Algonquin Lake in the Hills Food Pantry. Sponsored by the Algonquin Running Group at Lifetime Fitness, the entry fee was $10 worth of non-perishable food or cash and the run garnered a carload of comestibles for the Pantry.

After three months' publicaton the First Electric Newspaper readership now stands at about 1/3 the circulation of its now-defunct print predecessor. Your publisher can't decide if that's good, bad or indifferent, there being no precedent by which to judge.
In the past several weeks several readers have commented on FEN's makeup or web design. Whether FEN has a makeup or a web design cuts to the heart of the question.

LITH Volleyball and Basketball Leagues Forming
Signups are open for Lake in the Hills Parks and Recreation's Adult Co-Rec Volleyball and Adult Men’s Basketball leagues. Recreation Supervisor Trevor Bosack said the leagues offer a great opportunity for adults to get some exercise, relieve stress, and mingle with other active adults.
Teams are limited to seven members each and the number of games played will depend upon the number of teams registered.
For volleyball, games are scheduled between 7 and 10 pm Wednesdays in the Chesak Elementary gym beginning Sept. 16.
For basketball, games are scheduled between 7 and 10 pm Thursdays in the Martin Elementary gym beginning Sept. 24.

Wayne A. Harling, 86, of Algonquin died Saturday, Aug. 29, At Sherman Hospital in Elgin.
He was born Jan. 14, 1933, in Clinton. He was married April 19, 1952, in nearby L'Erable.
He is survived by his wife, Colleen Harling nee Marcotte; his children, Randy (Angela) Harling, Sharon (Robert) Vandermeir, Norman Harling and Michelle (Adam) Pringle; eight grandchildren, seven great-grandchildren; a sister, Jean Boudreau of Clifton; and many nieces and nephews.
He was preceeded in death by his parents, Verne and Edna (Madsen) Harling and his siblings, LaVerne, Paul, Earl and Orval Harling.
The visitation will be from 4 to 8 pm Tuesday, Sept. 1, at Willow Funeral Home, 1415 W. Algonquin Road. A Mass will be celebrated Wednesday, Sept.2, at St. Margaret Mary Catholic Church. Interment will be in Algonquin Cemetery.
Memorials may be made to St. Margaret Mary Catholic Church or the Algonquin Lake in the Hills Fire Protection District (Paramedics).

Rallies Set Against Human Services Cuts

Rallies are scheduled tomorrow in Chicago and Springfield against a plan to cut state human services and lay off workers who advocate for people with disabilities throughout the state.
A network of about two-dozen Centers for Independent Living were told earlier this month that starting October 1, a state grant that pays for recruiting and training personal assistants for individuals with severe disabilities would be cut. The so-called Home Services grant is funded through the Illinois Department of Human Services. It also pays for training of the people with the disabilities so they understand their civil rights when working with caseworkers and so they learn ways to manage their personal assistants.
The 23 Centers for Independent Living that operate throughout the state run on shoestring budgets, said Ann Ford, executive director of the Illinois Network of Centers for Independent Living based in Springfield. They already anticipated a 10 percent reduction in funding as part of the fiscal year 2010 budget agreement, which is expected to result in furlough days and potential layoffs. Cutting the Home Services grant on top of that would affect between 2,500 and 3,000 individuals who are served under the program each year, according to Ford.
Tom Green, spokesman for the Department of Human Services, said it all comes down to the budget. “It’s the toughest financial challenge that Illinois has ever had. Everyone has to make sacrifices. There’s a limited amount of revenue in the budget that was passed by the General Assembly, not enough to cover all the expenses. And DHS has made cuts in all budget areas.”
He added that cuts to community-based services would have been far deeper, as much as 50 percent, without a $3.4 billion borrowing plan approved by the General Assembly in July. About $2.2 billion of that was slated for community-based human services. But that same budget agreement also relies on Quinn reducing another $1 billion in spending. The General Assembly gave Quinn unprecedented discretion in where to cut.
On July 31, Quinn said that he would spread the cuts out in a way that would maximize federal matching and stimulus funds. And he said he would fund health-related initiatives that focus on disease prevention and that reduce demand for more expensive services later.

LITH Citizens' Police Academy To Mark Year 31
In 1994 "NYPD Blue" was in its first season purporting to show realistic cops fighting realistic crime. That's the same year Lake in the HIlls began its Citizen's Police Academy to show citizens how police work really works. "NYPD Blue" retired to Nielsen Heaven four years ago but the CPA is taking applications for its 31st session.
There's still time to sign up to learn about real police stuff like evidence, drunks, guns, gangs,legal rights, community relations and other areas of real law enforcement.
The program begins Sept. 14 and runs for 10 weeks, three hours each Monday evening. You have to be at least 18 and "clean" as they still say on the cop shows.

Alleged Gang Members Remain In Custody
Prosecutors convinced McHenry County Judge Michael Chmiel to treat two Lake in the Hills underage alleged gang members as adults last week. Fifteen and 16 year-old Wasfi and Mohammad Awwad are chaged with aggravated battery, mob action and unlawful contact with a street gang member in a beating in Lake in the Hills in early July.
Bother 18 year-old Mazin Awwad and 18 year-old Jonathan Rodriguez remained at last report in McHenry County Jail in connection with the incident.
In an unconnected case, alleged gang member 17 year-old Helver Martinez of Algonquin remains in Kane County Jail charged with spraying a Carpentersville residence with over two dozen slugs from a semi-automatic machine pistol during a drive-by shooting in June.
